All orders are subject to a fifty percent (50%) advance deposit.  Full payment due within 10 days of receipt of invoice. A 5% late fee will be charged if payment is delayed beyond 30 days.

OceanBlue Living reserves the right to create project-specific terms.

Order Acknowledgement:

Every order must be acknowledged by the purchaser by approval of the OceanBlue Living Quote & Design Approval in order to be valid and processed. Orders will be manufactured and invoiced based upon the information on the acknowledgement. If there is any discrepancy, please notify OceanBlue Living immediately.

Changes or Cancellations:

Orders entered and acknowledged cannot be changed or canceled without OceanBlue Livings written consent. Standard product orders may be rescinded & fully refunded within 48 hours of purchase order, after which the deposit is non-refundable. Custom product orders must be paid in full regardless of cancellation.

Powder Coat Finish Requirements:

Powder coating must be approved prior to acceptance of any order. OceanBlue Living assumes no responsibility for wear, fading, discoloration or any other defects in the performance of the powder coat specifications unless approved by OceanBlue Living to meet their standards and warranties.

Delivery of Freight & Damage:

OceanBlue Living reserves the right to use its own or commercial carriers for the “best way” to ship the products, at its sole and absolute discretion. When redelivery of merchandise is required because customer is not ready to accept merchandise, the order may incur storage fees and additional charges of as much as 5% of the value of the order. Title to merchandise shall pass to the buyer upon delivery by OceanBlue Living.

All products are packed to comply with standard carrier requirements. The consignee should carefully inspect all shipments before acceptance and the delivering carrier should be instructed to record any damage or shortage prior to signature. If further damage is found after delivery, immediate inspection by the delivering carrier should be requested. Notification of concealed damages must be made to the delivering carrier within seven (7) days after delivery of merchandise. Carrier liability ceases after seven (7) days after delivery. 

CAUTION: After obtaining a clear receipt for shipment, the delivering carrier is no longer responsible for damage or shortages. OceanBlue Living will not be held responsible for damage claims not due to freight.

Returns:

If the product or materials have been shipped as acknowledged, OceanBlue Living will not permit the return of any products or materials without written consent if the products and/or materials are shipped as acknowledged. 

Repair and Replacement:

Any labor charges for correcting a manufacturing problem must be submitted and approved before repair is undertaken, providing that the product or item is still under warranty. Labor charges will not be paid if the estimate was not submitted and approved prior to labor being completed.


RIGHTS AND WARRANTIES

Seven (7) year structural warranty

The warranty, which runs from the date of OceanBlue Living invoice, covers defects in materials and craftsmanship found in the course or resulting from the designed and normal intended usage of the product during the warranty period. If a product is defective, and if written notice of the defect is given to OceanBlue Living within the Applicable Warranty Period, OceanBlue Living at its sole option, will either repair or replace the defective product with a comparable component or product, or provide a refund of the purchase price to the original purchaser.

  • The 7 Year Warranty applies to all aluminum panels with OceanBlue Living standard designs and standard finishes. Custom designs, products, and finishes are covered under the warranty with written approval and consent by OceanBlue Living.

  • Installations must comply with local building codes and be approved by a project structural engineer, in addition to OceanBlue Livings installation requirements and guidelines to qualify for the 7 Year Structural Warranty.

  • OceanBlue Living reserves the right to inspect and photograph and distribute findings of all installations for industry education purposes, marketing, and project documentation.

  • This warranty does not include labor, installation, dismantling, or removal of the product to be returned for inspection. OceanBlue Living is not responsible for the cost of freight.

  • This warranty does not cover damage sustained by external causes outside OceanBlue Living’s control including adverse weather conditions.  


Ten (10) year finish warranty

  • Applies to OceanBlue standard powder coat finishes applied to aluminum panels by OceanBlue Living.  Powder coats applied to steel panels are not covered by any OceanBlue warranty.

  • Panels must use recommended fasteners (or of equal performance) and structural support for warranty to be in effect.

  • The 10 Year Finish Warranty is voided if panels are trimmed to size after finished with a powder coating.

  • Drilling holes for fasteners at OceanBlue Living -recommended size and spacing after finished with a powder coating will not void the warranty if drilling lubricant is not used.

  • Steel, wood, copper, and other materials are to be maintained by the purchaser and not covered under the OceanBlue Living warranty for finish.

The warranties stated herein does not apply to damage caused by a carrier or by alterations to the product not expressly authorized by OceanBlue Living or by products not installed per OceanBlue Living specifications. Additionally, this warranty does not apply to “Customers Own Material” (i.e.; material specified by the customer that is not a standard OceanBlue Living product offering) used in the manufacture of OceanBlue Living products. OceanBlue Living does not warrant the matching of color, grain or texture except to within commercially acceptable standards. A product will not be considered defective, and OceanBlue Living will not be obligated to repair or replace it, if the product is not installed or used as recommended in OceanBlue Living written planning, installation and/or user guides. The allowable tolerance of color, texture, and gloss variance is 10% from one panel or product to the next.

EXCEPT AS STATED HEREIN ABOVE, OCEANBLUE LIVING MAKES NO EXPRESS OR IMPLIED WARRANTIES AS TO ANY PRODUCT, AND IN PARTICULAR, MAKES NO WARRANTY OF FITNESS FOR ANY PARTICULAR USE OR PURPOSE. AT OCEANBLUE LVING SOLE OPTION, PRODUCT REPAIR, REPLACEMENT, OR REFUND OF PURCHASE PRICE IS THE TERMS AND CONDITIONS CUSTOMER’S EXCLUSIVE REMEDY FOR ANY AND ALL PRODUCT DEFECTS.

No oral or written information or advice given by OceanBlue Living its dealers, distributors, employees or agents shall in any way extend, modify or add to the foregoing warranty. OceanBlue Living shall not be liable for any consequential, economic or incidental damages of any loss (including, without limitation, damages for loss of business profits, business interruption and the like) arising from any product defect.

Products may not be licensed for reproduction without written consent of OceanBlue Living.
